GENERAL PURPOSE

Acts as Temporary Municipal Court Judge in the Angleton Municipal Court of Record. Works with the Presiding Municipal Court Judge.

Jurisdiction of court includes Class C misdemeanors, City ordinance violations, Class C juvenile cases, and as provided by V.T.C.A., Government Code Sec. 30.00005. The Municipal Court of Record has civil jurisdiction for the purpose of enforcing the City’s ordinances enacted under Subchapter A, Chapter 214, Local Government Code; Subchapter E, Chapter 683, Transportation Code; concurrent jurisdiction with a district or a county court at law under Subchapter B, Chapter 54, Local Government Code, with the City’s territorial limits and property owned by the City located in the City’s extraterritorial jurisdiction for the purpose of enforcing health and safety or nuisance abatement ordinances; the authority to issue search warrants for the purpose of investigating health and safety or nuisance abatement ordinance violations, and seizure warrants for the purpose of securing, removing, or demolishing the offending property and removing the debris from the premises. The City’s Temporary Municipal Court Judge will be appointed to serve a term of 2 years.


ESSENTIAL DUTIES AND RESPONSIBILITIES

The statements below are intended to describe the general nature and level of work being performed by individual(s) assigned to this position. They are not intended to be an exhaustive list of all responsibilities, duties and skills required of personnel so classified in this position. The position description is subject to change by the city as the needs of the city and requirements of the position change.

  • Magistrates City individuals in municipal jail during the work week, alternating weeks with the Presiding Municipal Court Judge
  • May be called upon in the absences of the Presiding Judge to
    • Conduct arraignments
    • Conduct Pre-trial disposition conferences
    • Conduct bench trials and jury trials in Municipal Court of Record
    • Conduct administrative hearings and signs warrants
    • Magistrate City offenders in municipal jail
    • Preside over juvenile hearings
  • Interprets laws, rulings, and regulations
  • Reads a variety of studies, reports, and related information for decision-making purposes
  • Exercises considerable independent judgment in managing dockets, ruling on motions, and adjudicating cases

Currently the Angleton Municipal Court holds court each Thursday of the month. The Temporary Municipal Court Judge will be asked to assist the appointed Municipal Court Judge as needed in his/her absence. The Temporary Municipal Court Judge must be willing to be contacted nights, weekends, and holidays for approval of Criminal Arrest Warrants, Search Warrants, and to magistrate capias pro fine warrants.

 

EDUCATION, EXPERIENCE, TRAINING, and LICENSE

Temporary Municipal Court Judges are required to be an attorney licensed and in good standing in the State of Texas as set forth in the City Charter. In addition, the following minimum knowledge, skills, and abilities to perform the essential duties and responsibilities of this position are listed below. The city reserves the right to allow substitutions if a candidate or incumbent exceeds requirements in one area but may be deficient in another.

Education, License, and Experience

  • Licensed attorney by the State Bar of Texas required and in good standing
  • Five (5) or more years of experience in the practice of law in Texas required
  • Judicial experience is preferred, but prosecution experience may be considered

Special Qualifications

  • Must be competent in the law, and be independent, fair, dignified, and courteous
  • United States citizenship required
  • Texas residency required
  • Must be Bondable
  • Execute anti-bribery statement prior to taking oath
NECESSARY KNOWLEDGE, SKILLS AND ABILITIES

Knowledge of state statutes relating to municipal affairs; relating to land use, environment, and traffic; City Ordinances, criminal law, Penal Code, Code of Criminal Procedure, Transportation Code, Juvenile Law, Alcoholic Beverage Code, Health and Safety Code, Texas Rules of Evidence and state criminal laws that are filed in Municipal Court, and modern policies and practices of municipal law and public administration.

Skills in preparing briefs and other legal documents; operating personal computer, telephone, scanner, copy machine, and fax machine.

Ability to prepare and analyze comprehensive legal documents; carry out assigned projects to their completion; communicate effectively verbally and in writing; establish and maintain effective working relationships with employees, city officials, the court system, and the general public, and efficiently and effectively administer a judicial department.

SPECIAL REQUIREMENTS

Must not be a party or attorney in any lawsuit against the City of Angleton, must not be an attorney representing defendants in Angleton Municipal Court of Record or Village of Bailey’s Prairie or any case on appeal from these courts, have any other conflict of interest and must not have any outstanding delinquent City of Angleton monetary obligations. Preference will be given to local candidates.

The work environment characteristic described here are representative of those an employee encounters while performing the essential functions of this job.

Office environment, employee is required to keep their personal workspace in a reasonable and organized manor. This job is typically office based with little to no exposure to the outdoor elements. The noise level in the work environment is usually moderate but may increase on court days.
